The Hard Rock Casino in Las Vegas could fall on hard times thanks to a new lawsuit by New Jersey resident Thom-Matthew Kho. Kho is seeking damages of more than $10,000, in addition to punitive damages and attorney’s fees, based on claims of theft, false imprisonment, and battery.
The man claims the casino illegally detained him and stole roughly $3,600 in casino chips last month. The Review Journal, based in Las Vegas, said the casino kicked him out and took the chips after they caught him counting cards at a blackjack table.
While card counting is not illegal in Las Vegas, those suspected may be asked to leave any casino. Kho claims his removal from the casino was based solely on card counting and violated his rights.
Kho is represented by Las Vegas attorney Robert Nersesian, who represented Ross Miller when he filed a similar lawsuit against Planet Hollywood Resort earlier this year.
According to the lawsuit, the casino’s security team handcuffed Kho on the casino floor and then took him to a security office where he was held against his will and then searched despite his complaints.
The lawsuit claims the resort had a duty at that point to notify the Nevada Gaming Control Board about the dispute, which it had yet to do at the time of the filing. It also said Kho suffered physical injuries “in the form of contusions and abrasions.”
The complaint says Kho “was not legally required to provide identification, desired to maintain his privacy and anonymity, and refused the request while requesting that the chips be cashed.” It also claims Kho felt the casino was taking advantage of their authority in obtaining unnecessary personal information to share with a third party.
A defamation case is also in the works. Kho said those who witnessed the altercation likely now see him as a criminal.
According to the case, Kho says the incident resulted in the “destruction of his vacation to Las Vegas.”
